Government takes action in favor of people with disabilities

The draft budget for 2022 marginally revises the calculation of the disabled adult allowance by creating an allowance on the spouse's income.


In terms of solidarity, several measures should be noted in the finance bill (PLF) for 2022 presented on Wednesday. The government has decided to do something for people with disabilities. In order to support disabled people living as a couple with modest incomes, it proposes a reform of the calculation of the Disabled Adult's Allowance (AAH). The text provides for the creation of a fixed allowance of 5,000 euros on the spouse's income, increased by 1,100 euros per child. This measure will lead 120,000 households to benefit from an average increase in the allowance of 110 euros per month at an estimated cost of 200 million euros. This measure comes at a time when people with disabilities living as a couple would like the calculation of theAAH does not take household resources into account but either pays them individually as compensation for their disability. Because as soon as the spouse's income reaches 1,020 euros per month, the AAH begins to decline.

The government has so far refused to accept this “deconjugalization” of the AAH, justifying its position by the fact that national solidarity does not have to replace solidarity between spouses, enshrined in the Civil Code.

With the measure included in the PLF 2022, the executive is nevertheless making a marginal gesture in favor of the most modest.

Note that since the start of the five-year period, this financial assistance for people with disabilities has been increased in stages: from 810 euros per month in 2017, it was increased by 50 euros in 2018, then by 40 euros in 2019, bringing its current amount to 903.60 euros per month.

Another measure in favor of solidarity, the transfer of the financing of the active solidarity income (RSA) from the departmental council of Seine-Saint-Denis to the State is integrated in this PLF for implementation from 2022, in order to give the department for additional leeway to strengthen its integration policies.

The government also intends to continue next year funding strategies to fight poverty and protect children to the tune of 465 million euros in 2022, an increase of 25 million euros compared to the law. finance 2021.
