The ICAC received a corruption complaint earlier and launched an investigation. After completing the investigation, it sought legal advice from the Department of Justice. According to the relevant legal advice, 12 people were charged with 15 counts of conspiracy to falsify accounts and violated Article 19 of the Theft Ordinance. (1) Section (a) and Section 159A of the Crimes Ordinance.

Among them, the 11 defendants were Mai Baipei, Huang Zhiqiang, Xian Runsen, Huang Haide, Lai Canchao, Zeng Lixiong, Chen Zongyao, Chen Juncheng, Ye Hui, Wen Xiaoming and Zhang Yongkang, aged between 52 and 65, all of whom were Xinxing Container Transport at the time of the case. The remaining defendant is Yin Zhixing, 71 years old, the operator of Xinhao Company and Chuode Parking Co., Ltd.

The 11 container truck drivers involved were hired by Xinxing at the time of the case, the company providing cross-border transportation services.

The emerging container truck drivers must drive the container truck to the container weighing company to weigh the containers in order to declare the weight of the cargo to the customs.

The container weighing companies involved in the case include Xinhao and Chuode which are operated by Yin Zhixing.

The driver of the container truck needs to advance the cost of weighing the container, and then submit the relevant weighing receipt to Xinxing to apply for the reimbursement of the relevant expenses.

According to the case, the suspected crime occurred between March 1, 2016 and October 25, 2019.

The charge alleges that the 12 defendants conspired together and conspired with other persons to benefit themselves or another person, or intended to cause another person to suffer losses, and dishonestly falsified the act issued by seven container weighing companies. The weighing receipt for accounting purposes is to approve false entries on these documents to show that the weighing fees charged by the seven container weighing companies range from $90 to $150.

The ICAC's investigation found that the seven container weighing companies mentioned above, including Xinhao and Chuode, actually charge a weighing fee for each container ranging from $25 to $110.

The 11 drivers involved were suspected of submitting a total of more than 4,900 weighing receipts to Xinxing, exaggerating the weighing fee by more than 390,000 yuan.

Xinxing provided full assistance during the investigation of the ICAC case.
