The association that wants to build a wooden chapel in the Isar floodplains in Dietersheim has bad cards.
The district office rejects the plans for reasons of building law.
Eching / Dietersheim
- The community initially had a positive
view of
the project, which was based on a private initiative.
According to the documents, the planned chapel is 9.50 meters long and 3.70 meters wide.
That corresponds to a good 30 square meters.
An area of around 200 square meters is required for the intended area around the chapel.
In early March, the construction committee gave the project, which was planned on community land, to the agreement.
However, under the stipulation that an outdoor facility plan must be submitted for the open spaces.
Independently of this, the district office informed the client in a letter in mid-June that his project could not be approved.
The property is located in the outside area, or rather in the landscape protection area, where normally only agricultural buildings have a view of approval.
Except, as Mayor Sebastian Thaler explained, the municipality would change its zoning plan for this purpose.
Up to now it was assumed that there would be a special regulation for such a project.
Is a change of personnel the reason for the rejection?
The unexpected negative attitude of the district office led Thaler possibly back to a change of staff. “That is a special request from the Freising District Office,” said Thomas Bimesmeier, Head of the Building Department. Herbert Hahner (SPD) wanted to know whether something could not be done "through the small official channels". “I already did,” said Thaler, visibly disappointed. Bimesmeier then questioned the project. "If there is no chance, then it just won't work out there," was his assessment.
In any case, they were not entirely enthusiastic about the change in the zoning plan.
Axel Reiss (Greens) advised “to distance yourself from the project”.
It was a tight decision from the start.
He spoke of "a private matter" and that the association should "implement the building project elsewhere".
Other committee members such as Georg Bartl (CSU) made it dependent on "that the community incurs no costs".
Especially not for changing the land use plan.
Bimesmeier had assumed an estimate of 10,000 euros.
The question of costs should remain a matter for the sponsoring association
In the end, it was agreed in the committee that first of all the general approval capability should be checked by means of changes to the zoning plan.
The project was to be submitted again to the building committee for a resolution to be drawn up, it said.
When it came to the question of costs, it was agreed that it was a matter for the applicant, i.e. the sponsoring association.
Even this decision was not an easy one for everyone.
There were two votes against.
