The police requested today (Friday) the release of Eran Azulai, the suspect in the trampling of the boy Barak Khoury on the eve of Yom Kippur, after the State Attorney's Office has not yet submitted a prosecutor's statement of intent to file an indictment against him.

This morning the police arrived in court and despite wanting the indictment to be filed against Azoulay while in custody, she was forced to ask the court to release him under house arrest for two weeks.

In addition, the police requested a signature on bail, a ban on leaving the country and an undertaking to attend the investigation at their request.

Yesterday, Tel Aviv Magistrate's Court Judge Adi Hadar extended Azoulay's detention for a day. 

On the eve of Yom Kippur, a fatal car accident occurred in which Azoulay, who was allegedly driving while intoxicated and under the influence of a cannabis drug, hit Barak Khoury.

Azoulay had previously been convicted of a drunken car accident, and at a hearing held yesterday, a police spokesman noted that the driver of the rapist was not only under the influence of alcohol but also a cannabis-type drug.

The police representative noted before the hearing that the police had received requests to complete legislation, and in the process additional actions arose that required on the one hand to strengthen the existing investigative material, and on the other hand to add new material.

Judge Adi Hadar, who extended Azoulay's detention, wrote in his decision that as long as the police are expected to continue the investigation of the accident after seven days, which apparently does not raise a special investigative difficulty until a prosecutor's statement is filed, this position creates difficulty.

"The court is not content this time with advising the investigating unit to go to the prosecutor's office and examine how to proceed with the case, but expects that as long as the prosecutor's office is dangerous to the respondent, a prosecutor's statement will be submitted - and no, the investigation will continue."
