The removal order in the neck, the relief of the landowners present in Frieding Nord was noticeable after the decision. The deadline set by the administrative court would have expired at the end of the year. The land-use planning for the industrial park took twelve years to complete, and on Thursday the Andechs municipal council put an end to it, giving the existing businesses their authorization.

Triggered by a single application, the idea arose 15 years ago of creating development opportunities for the entire area. The first wrap-around was far too big, in the end the lawyers recommended that project-related development plans should be drawn up for the existing businesses. Through implementation contracts, they have to adhere more strictly to the stipulations than is the case in binding development plans. In the course of the long negotiations, a citizens' initiative was founded, which ran a storm against the plans until the end, complained and submitted petitions.

Local attorney Dr. Gerhard Spieß has been accompanying the process for eight years, his colleague Johannes Mohr, who represents the landowners, has been involved for twelve years. After the final consideration, both breathed an audible sigh of relief. But also in the final sprint they had another sharp wind blown against them. For example, when Peter Schmaderer (Greens) interjected that a decision from 2016 had simply been ignored. This concerned the designation of a general residential area on the south-western border of the industrial park. In fact, the local council decided at the time to make correspondingly strict noise requirements there, which in retrospect turned out to be not feasible, as the existing operation there must not be shaken. The general residential area has therefore become a mixed area with lower noise requirements."But there was no mistake," assured Spieß.

Schmaderer's parliamentary colleague Judith Birken also did not want to make friends with the industrial park. As a mother, she is concerned about the safety of the children and fundamentally cast doubt on the 2015 traffic report by Professor Harald Kurzak. She had the Hartstrasse in particular in view. However, this is not part of the land-use planning for Frieding Nord. The assurance in consideration that the community would “try” to increase traffic safety by building sidewalks was not enough for her. The majority of the Council agreed, however, that there was no immediate need.

Schmaderer, Birken and Katharina Linze (also Greens) stayed with them: The now permissible development opportunities for the existing businesses went too far for them. In this context, Judith Birken also referred to changes in use, which, however, were approved, according to Spieß. Specifically, it was about a tire trade that has meanwhile rented Franz Zerhoch's company for a period of one year - but only until its own on Leonhardweg is ready. Probably in November.

Many objections, especially those of the so-called carriers of public concerns such as authorities in the district office or water management office, were taken into account in the development plans of an editorial nature. Most of the considerations were adopted unanimously, otherwise only against the votes of the Greens group. A second interpretation is therefore not necessary. As soon as the statutes are announced, the companies can implement their expansion plans or they no longer have to worry about having to dispose of their inventory. This is secured with the land-use planning.

In accordance with this requirement, an application was also made to remove a small area in the landscape protection area, which mayor Georg Scheitz, as reported in the run-up to the meeting, did not consider it worthy of protection.

The demand from Schmaderer and Birken to create a suitable balance was called unusual by Spieß.

And Scheitz pointed out that around 80 percent of the municipality is in the protected area: "If we wanted to balance, we would almost have to go inside."
