- Thanks to his good behavior after the crime and his confession to the police and before the judge, a Rottach-Egener (20) got off lightly at a trial against him at the Miesbach district court. In view of the offenses he was accused of, he could well have expected a higher sentence. After all, the young man made himself a criminal offense for the deliberately illicit acquisition of narcotics - in a total of 42 cases. As the prosecutor submitted, the defendant is said to have purchased narcotics from a trusted dealer in Tegernsee between December 2019 and February 2020. Four times it was 50 grams of marijuana at a gram price of eleven euros each. On three other occasions, the Rottacher is said to have bought 100 grams of marijuana for ten euros per gram from his dealer.As if that weren't enough, the public prosecutor's office also accused the 20-year-old of having obtained two ecstasy tablets for ten euros each 35 times.

20-year-old makes a comprehensive confession

"He admits it and he is sorry," said defense attorney Frank Zahnert immediately after reading out the indictment.

Zahnert explained the circumstances of the crime in such a way that his client had a short period in which he was using drugs.

However, this has no longer been the case since spring 2020.

"In addition, he had the wrong circle of friends at the time, but has since moved away from them," assured the lawyer.

While Zahnert was still making it clear that Rottacher had steered his life back on the right track, he submitted two negative drug tests for the defendant to district court director Klaus-Jürgen Schmid.

They are from March and April of this year.

It was also important to Zahnert to emphasize that his client “did not consume everything himself”.

The 20-year-old was more the middleman.

He took orders from his friends at the time and then placed the bulk orders with the dealer, picked them up, kept his part for himself and distributed the rest to the former circle of friends.

After the complete presentation of the events for Schmid, he even renounced the only witness who should have testified in court.

Consultations and payment

In her plea, the prosecutor complained that the acts were certainly not a trivial offense. On the other hand, she still wanted to leave it to the application of juvenile criminal law, "because you confessed today and have dealt intensively with everything that went wrong," said the lawyer to the defendant. She demanded three consultations with Caritas and a monetary requirement of 900 euros. In addition, the Rottacher must remain drug-free for another year and be able to prove this.

"Yes, it was a multitude of acts and also a large amount," said defense attorney Zahnert.

Nevertheless, the incidents were a long time ago and his client now leads "a normal and age-typical life".

From his point of view, the counseling sessions would still do no harm, and it was also possible for the 20-year-old to live drug-free.

Zahnert felt that the required € 900 payment for the defendant, who is currently doing an apprenticeship, was a bit too high, "even if they were definitely justified".

Drug screening as a condition

Ultimately, Schmid hummed the Rottacher, in addition to three consultations and two drug screenings to be completed within a year, a monetary requirement of only 700 euros.

"But only because you showed yourself repentant in your closing remarks", Schmid remarked in the direction of the accused, who also apologized expressly to the judge for his offenses and vowed to get better.

With such a large amount of narcotics acquired, according to Schmid, commercial activity is still obvious.

"But you can't prove that, and it's not charged here either," the director recognized.

The drug counseling and the drug screenings would not harm the 20-year-old, said Schmid and warned: "If one of the screenings is positive, there is an arrest."
