A host on the Schwanthalerhöhe would like to use his pub garden beyond the Corona period.

The city of Munich has generally already answered in the affirmative, but politicians are now hesitating to approve it.

Because: It would set a precedent.

For Thomas Eberlein, his Schanigarten is a complete success. He has been running the Bürgerheim at Bermannstrasse 33 for 13 years. With success - at least until the corona virus thwarted his plans: hygiene concepts, distance rules, vaccination certificates. Hosts have not had and still have an easy time of it. Then came the pub garden and with it 50 to 70 additional seats, which are almost always well attended. "The pub garden is used regardless of wind and weather," reports Eberlein.

The landlord tried a lot to offer his guests something: a tent against the rain.

A platform made of larch wood, so that the pub garden is barrier-free.

Large umbrellas now let the sun through and offer some protection at the same time.

The residents are also satisfied, reports Eberlein.

The pub garden offers a better quality of life, and that for a small price: four parking spaces have been built over, but there is still space for three cars along the garden fence.

The landlord wants to use the pub garden from April to October every year

Eberlein would therefore not only like to use his pub garden during the Corona period, but every year from April to October.

With this idea he turned to the district committee Schwanthalerhöhe (BA).

There, however, the proposal received a divided response.

BA man Holger Henkel (SPD) fears that a precedent could be set

BA man Holger Henkel (SPD), the chairman of the building committee, fears that a precedent could be set if the citizens' home were allowed a permanent pub garden.

Other hosts could refer to this decision in their applications.

After all, there are already restaurants that offer far more outside seating than inside.

"First of all, we would like to get an idea of how not only the guests, but also the residents of the neighborhood feel about the pub gardens," said the SPD man.

He wants to decide on the proposal in winter.

“We haven't had any complaints so far,” said Florian Kraus from the Greens.

“That's why I don't see any reason to postpone a decision any further.” And the BA chairwoman Sibylle Stöhr (also Greens) pointed out that the city council had already laid the foundation in May to continue running pavement gardens beyond the Corona period.

Thomas Eberlein does not want to wait until winter, the approval of the politicians would be an important sign for the gastronomy, he says

Landlord Eberlein doesn't want to wait until winter. “The flood of applications will come,” he said, “whether the decision will be postponed or not.” For Eberlein, the early approval would be an important signal from politicians to the catering industry. You could encourage the hosts to think about it and also to take money into their hands to find suitable solutions for the pub gardens for everyone. Commissioning architects, submitting building applications - it all takes time. “And a pub garden in winter 2022 won't help anyone,” emphasized Eberlein.

BA politician Daniel Günthör (Greens) therefore proposed a compromise solution: If the district parliament were to decide on the application in its November session, the landlords would have enough time to plan.

Until then, the BA could question the residents.

The BA chairwoman Stöhr added, however: "If we wait until November, I hope to find a solution" that is worth the delay.

“I don't feel like discussing here for hours without a result,” said the Green politician.

The local politicians voted for the postponement of the motion with a narrow majority.

The final decision is to be made in November.
