Leipzig - The Dresden Regional Court imposed imprisonment between four and a half and eight years in prison against the management team of the financial service provider in 2018.

They are said to have operated a pyramid scheme and deceived thousands of investors.

Five of the men were found guilty of commercial and gang fraud as well as capital investment fraud, in another case it was about aiding and abetting.

All filed an appeal (Ref .: 5 StR 443/19).

At the hearing, the lawyers of the ex-managers put forward a number of reasons why, in their opinion, the judgment should not stand.

Among other things, not enough witnesses were heard at the time, and the defense lawyers had no access to all the data found during searches.

A proper defense was not possible in this way.

The lawyers applied for the judgment to be set aside and the case to be tried again - either at another criminal chamber in Dresden or at the Leipzig Regional Court.

The attorney for the executive convicted of aiding and abetting requested acquittal.

The Federal Prosecutor's office requested that the revisions be discarded.

Then the 2018 ruling would become final.

The BGH wants to announce a decision on October 29th.

The Federal Court of Justice (BGH) had rejected the appeals by Ali B. and another defendant against the decision of the Wiesbaden Regional Court of October 2019 as unfounded, said a regional court spokesman on Monday.

The “Allgemeine Zeitung” in Mainz had previously reported on the decision of the Karlsruhe court.

A notice from the Bundesbank and the financial services regulator BaFin started the investigation in mid-2012.

The Dresden Regional Court was convinced that the aggrieved investors invested in bonds and other financial products with a total value of 542 million euros and that only a part had been repaid until the Infinus business operations were discontinued.
