A U.S. Navy engineer and his wife are accused of trying to sell nuclear secrets, the Justice Department said yesterday (Sunday).
Jonathan Toby and his wife Diana were arrested in the state of West Virginia on Saturday, and are accused of trying to sell nuclear submarine planning data, hidden in a peanut butter sandwich, to a man they thought represented a foreign state.
In fact, it was an undercover FBI agent.
Toby, 42, and his partner, 45, are charged with violating the Atomic Energy Act.
Toby worked in the Navy's nuclear propulsion program and had a high security classification.
According to the Ministry of Justice, in April last year he sent a package to a foreign government containing confidential data and a proposal for secret cooperation so that it could purchase more information from it.
Subsequently, he began sending emails via encrypted e-mail to the same FBI agent he thought was a representative of the foreign government.
The name of that government was not specified.

After a few months, the couple made a deal to transfer confidential information for about one hundred thousand dollars in digital currencies.
In June, the two traveled to Virginia West to pass on the data.
According to the indictment against them, while Diana was watching the scene, Jonathan "placed a hidden memory card inside a peanut butter sandwich" at a predetermined location.
After the agent collected the memory card, he passed the payment to Toby and received a code to open it.
The card contains confidential information about nuclear reactors in submarines.
In August, Toby delivered another package - this time hidden in a chewing gum package - with additional confidential data.
And on Saturday, in the alleged third delivery, federal agents arrested the couple who will appear in court tomorrow.
