Stuttgart - The mask requirement for vaccinated or recovered employees, for example in the catering trade, is to be relaxed again very soon. Social minister Manne Lucha (Greens) and the state data protection officer Stefan Brink agreed on this in a conversation on Friday. According to this, vaccinated or recovered employees of restaurants and cafés, for example, can do without a mask to protect against the coronavirus, provided the employer agrees and this complies with the occupational safety and health ordinance.

The current Corona regulation, which still prescribes a mask requirement, will be adapted accordingly, Lucha told the German Press Agency.

He promised an "as simple and practicable application as possible for the employees".

"Then vaccinated and recovered employees at 2G no longer have to wear a mask at their own request," said Lucha.

The new relaxations should not only apply to the catering trade, but wherever there is a so-called option model for vaccinated or recovered guests at events or in the catering trade.

So far, the new corona rules that came into force on Friday provide for a mask requirement for employees in companies that are open to the public.

The latest decision was preceded by a dispute between Brink, the country's top data protection officer, and the head of the Ministry of Social Affairs, Uwe Lahl.

He does not think it is understandable if vaccinated waiters have to wear a mask according to the new Corona regulation, but vaccinated guests do not, Lahl had told SWR television and added: "That got us the data protection officer of the country."

Brink was against the fact that those who are vaccinated do not have to wear a mask, because this would make the mask wearer recognizable as not vaccinated.

“And he spoke out against it,” said Lahl.

Therefore, everyone would have to "bite into the sour cucumber - that is, put on a mask," he said.

Brink, however, rejected the allegations.

A possible relaxation of the mask requirement for employees was by no means unsuccessful due to a "veto" of data protection.

He advised against loosening the mask requirement only if entire groups of employees disclosed their vaccination status to the employer.

This could cause them to conflict with one another, which in turn would call into question the voluntary nature of the disclosure.

"Of course, data protection as a basic right to informational self-determination gives every citizen the right to share their vaccination status with others, including the employer," Brink made clear.

However, undue pressure should not be exerted on this decision.

"That is why the employer is generally not allowed to ask for health data of his employees."

With the new regulation, the state government is now taking up a suggestion made by Brink.
