On September 10, 2020 around 6.30 p.m., the Wolfratshauser was driving his car on the B11 in Geretsried with just under 2.3 per mille. “It can't really be that high,” muttered the pensioner into his mouth and nose mask. He only drank two beers at home before a friend called to meet him at the glider airfield in Königsdorf. On the way there he had to pass an accident site, a motorcyclist had rushed against the guardrail. "I should drive around the barrier, but I drove behind it," the man described the moment when the police noticed him. In the protocol of his examination, a doctor noted that the senior seemed to be “clearly under the influence of alcohol”. "That was probably a good intoxication," speculated the judge.

To make matters worse, the defendant was only convicted in spring 2020 of endangering road traffic.
At that time the blood sample showed a value of 1.7 per thousand.
He had only got his driver's license back in April of this year.
"That is an enormous relapse rate," the judge held against the pensioner.
Since it is not done with "huge nonsense" - as the 70-year-old described what happened.
The behavior is simply irresponsible.
"Then I can't cover myself up at home and drive off when a friend calls."

In his judgment, Berger followed the prosecutor's request.
The five months' imprisonment is suspended for three years.
In addition, the Wolfratshauser has to pay 1500 euros to the federal government against alcohol in road traffic.
The pensioner accepted the judgment.
