Bankruptcy law turned upside down in France

DECRYPTION - While a speedy procedure is created for small businesses, law reform for larger companies is controversial.


If the commercial courts are idle as there are so few cases, company law in difficulty is evolving. A rapid procedure for SMEs and VSEs (less than 20 employees and less than 3 million euros in turnover) in suspension of payments has thus been created. In three months, a debt clearance plan can be put in place, with a spread of debts up to ten years.

"This measure targets small businesses that are experiencing difficulties because of the health crisis, but which are structurally viable and healthy - they must have reliable accounting and be up to date with salaries,"

explains Laurent Jourdan, associate lawyer at Racine. But this

"crisis recovery treatment procedure"

, voted in June and whose implementing decrees are due out this week, will it be successful?

Lasting two years, it was imagined in the spring to come to the aid of an economic fabric supposed to be weakened by the withdrawal.
