The situation in the capital was chaotic at times on election Sunday.
The Berlin Senate then apologized, and the state returning officer appealed against her own election.
Andreas Now the next breakdown: Andreas Otto from the Greens had won his constituency in Pankow.
However, the city sent the documents for the acceptance of his election to the Berlin House of Representatives to a namesake.
Otto confirms this to SPIEGEL on request.
He has not yet received personal confirmation of his choice.
Andreas Otto, FDP local chairman in the Reinickendorf district, was not elected to the House of Representatives in contrast to Otto der Grünen (Pankow district).
But he received the invitation from the capital to accept the election and his supposed mandate.
After the elections to the Bundestag, the House of Representatives and the district assemblies on September 26th, reports of missing or incorrect ballot papers, possible counting mishaps and other problems had accumulated.
Irregularities in more than 200 polling stations
The regional election control had previously announced that it would appeal to the Berlin Constitutional Court against the results of the election for the House of Representatives on September 26th.
There were violations of the electoral law in two constituencies.
Overall, there were irregularities in the election to the House of Representatives in 207 of 2,257 polling stations, as the state returning officer Petra Michaelis announced at a meeting of the election committee.
"That's a number that must both frighten and annoy us all," she said.
On the other hand, she could state that the election in over 2000 polling stations went off without any problems.
