Agenda item number 2 concerns the "amicable termination of the existing management contract with Wendelstein Immobilienverwaltungsgesellschaft mbH as administrator" and its removal.

Reason: "Due to the insolvency of Wendelstein Immobilienverwaltungsgesellschaft mbH, the administration cannot continue", so the contract should be terminated.

As can be seen from the current insolvency announcements, the proceedings for “insolvency and over-indebtedness” were opened on September 1, 2021.

A lawyer from Mühldorf was appointed as the insolvency administrator.

He had now invited to the assembly of the homeowners association (WEG).

A quarter of a million is missing from the reserve account: only around 28,000 euros left

The underground car park extends under large parts of the former Rodenstock site with around 200 parking spaces.

The owners of the underground parking spaces have already received initial information.

Accordingly, as of June 30, 2021, there was an arithmetical reserve account of EUR 269,998.30.

In fact, only 27,753.92 euros would have been found on the accounts.

This results in a deficit of EUR 242,244.38.

Almost a quarter of a million that could be lost.

"According to the bankruptcy application, the deceased managing director used amounts of money from the reserve accounts of various WEGs for purposes other than those intended," the insolvency administrator informed the owners, who pointed out as a precaution that the figures correspond to his current knowledge.

However, he cannot yet guarantee the correctness.

In a letter to the owners, he assured them that he would endeavor to have the property managed by a new manager.

The Mühldorfer lawyer points out in his letter that “only your property management company, but not the WEG itself, is in the insolvency proceedings.

At the same time, it is ensured that disposals of WEG accounts can only be made with my consent. "

Another duty: owners have to pay

This is little consolation for those affected. As an owner reported in an interview with the Ebersberger Zeitung, the reserve has been increased in recent years through additional monthly payments. He is not aware of the amounts that have flowed into pending renovation work in the underground car park. "Some of the money has probably been diverted and is now gone," he fears for the reported shortfall. That is bitter, especially because of further necessary work.

Additional information from the insolvency administrator aims in this direction: All owners, "he writes," are still obliged to pay the house monies on time.

The non-payment only damages your own WEG and may even get you into financial difficulties. "He has already" given approval for payments to energy suppliers, elevator companies, municipalities and insurance companies to ensure the ongoing operation of your property. "Therefore, the owners are not entitled to revoke the direct debit authorization.

How much and whether the owners will see any more money from the "misappropriated" sum will ultimately have to be shown by the insolvency proceedings.
