The Haifa District Court today (Wednesday) extended for five days the detention of Abu Sanan resident, Zakaria Haj, 33, who was arrested last night on suspicion of a criminal terrorist attack by security guards stationed at the entrance to the Nahariya hospital area, with an ax he removed from his vehicle.

This, after Hajj was not allowed to enter with the car when he came to visit his wife who had given birth the day before.



Earlier today, in the Krayot Magistrate's Court, Judge Eran Naveh granted defense counsel Adv. Basel Fallah, representing Hajj, and ordered his release tonight, noting that police have delayed arresting him since the incident four days ago. To the hospital and there was no case of violence in relation to him. "In response to the decision, the police immediately appealed to the Haifa District Court, where Judge Amir Toby reversed the decision.

"I agree with the court that such acts should be condemned but it will come at the sentencing stage," defense counsel told Judge Toby.



"His wife is alone at home with the baby and his father is disabled. I understand that the behavior is disgusting but do not require arrest. He is really a good boy, it is not typical behavior," he said, adding that "the next day he came to release his wife with his son, he met security guards and he apologized."

He said, "He owns a company and is not expected to behave that way, but it cannot be said that only an arrest can educate him."

"The appeal is admissible," Judge Toby ruled, noting that he does not see eye to eye with Judge Naveh:

"Every act of violence begins with a loss of control," he said.



The judge further noted that the man was sprayed with pepper gas by hospital security guards, who felt they were in danger after being attacked by him.

He stated that there was a sufficient evidentiary basis on which to establish more than a reasonable suspicion of the commission of the attributed acts and that "there is no need to say too much about the danger inherent in his actions."

He mentioned that the court has on numerous occasions referred to the severity of physical or verbal violence directed at public servants.



"The culture of recent incidents of violence against public servants, including doctors, nurses, medical staff and security guards, requires appropriate treatment."

According to the judge, "this is someone who did not hesitate to use an ax that he waved in front of the security guards in a threatening manner. This conduct requires strict consideration even at the stage of detention."
