Attorney General Avichai Mandelblit said today (Thursday) that Justice Minister Gideon Saar's bill, which prevents a criminal defendant from committing a disgraceful formation of a government, is not personal. "The amendment is not personal but general, and looks to the future," he said. "This, while imposing appropriate restrictions and control and audit mechanisms, taking into account other important regime principles that apply in a democracy." Mandelblit made the remarks at a conference on "Ethics of Public Elected Representatives," on the second anniversary of the death of former Supreme Court President Meir Shamgar of Tel Aviv University.
Mandelblit referred to his position in the High Court that was filed against the imposition of the government train on Benjamin Netanyahu, according to which in the legal situation he could not be prevented from receiving the mandate, and the High Court accepted this position but ruled that the issue should be regulated by legislation.
"I believe that the proposed amendment to the Basic Law does not create anything out of thin air," Mandelblit explained, "in the sense that it follows in the footsteps of legislation and Supreme Court rulings in general, and the ruling of President Shamgar in particular, which deals with eligibility for public office."

He added that "President Shamgar's command - both in his judgments and in his academic writing, is that we must do everything in our power to defend the exercise of governmental power fairly. Strengthen the principle of public loyalty.
The proposed law seeks to go this way and adjust the legal situation "Others, also in relation to the eligibility to serve as prime minister. It must ensure that statehood prevails over any personal interest."
