The already drunk adolescents aged 18, 19 and 20 did not find the drinks they were hoping for.

Instead, they broke open lockers and stole 300 euros from them, a tip from the service staff.

Now two brothers had to answer for theft in the juvenile court, their friend, who had confessed to the unfortunate Schmiere campaign, for aiding and abetting the theft.

He was hit hardest by the verdict - just as the judge threatened him at his last hearing in summer 2020.

The incident occurred on Epiphany this year in a community in the north of the district.

All three defendants admitted the allegations they had made.

While taking a walk, they noticed that the door of the storage room was open, so they had the crazy idea of ​​“getting something to drink”.

Breaking open the lockers was not planned, but resulted from the situation.

Boys confess what their mother did

Driven by a guilty conscience, they had confessed to their mother's nocturnal mischief.

They put the money back in the lockers.

They also settled the damage to property in the amount of 500 euros.

Since the landlady of the restaurant was not interested in prosecution and the brothers had not been criminally guilty, the proceedings against them were dropped.

In return, they each have to do 16 hours of community service, and they were also banned from consuming alcohol for six months.

For the 20-year-old, who had stayed in front of the door and made sure that his friends could act undisturbed, youth court assistant Andreas Dlugosch suggested abstinence from alcohol for one year. And two free time arrests. The young man was threatened with this at his last of three negotiations in August of last year if he turned up again in court. Just four months later, he had committed another offense. "I don't have a meaningful explanation for this," said the student. "I was drunk, wanted to have another drink and didn't think twice."

The public prosecutor applied for him to be sentenced as suggested by the juvenile justice department.

He thinks that is "completely exaggerated," argued the student's defense attorney.

Especially since he made up for the damage and overall "a very clear development" for the better can be seen.

"It is correct that there was a warning of arrest, but you have to leave the church in the village," said the lawyer.

Judge remains tough

Judge Friederike Kirschstein-Freund followed the prosecutor's request.

She believes that leisure arrest is necessary "to show you that it is not possible," argued the judge.
