Souza told them that Baldwin was "sitting on a bench in a church building, and that he was practicing a cross shot," the affidavit says.

A cross draw is when a shooter draws the weapon from a holster on the opposite side of the body from the hand that is drawn.

Souza was looking over Hutchins' shoulder "when he heard what sounded like a whiplash and then a loud bang," according to the affidavit.

Souza also confirmed to an investigator that he heard the term "cold weapon" on the set of "Rust," meaning that the firearm should have been empty.

According to the court order, Souza said that three people had tampered with the firearms for the scenes, which were checked by the gunsmith and the first assistant director and then handed over to the actor who used them.

The investigator said Souza was not aware of anyone on set being checked for live ammunition before or after shooting the scenes.

"The only thing that is checked are the firearms to avoid having live ammunition in them. Joel (Souza) stated that there should never be live ammunition near or around the scene," the affidavit said.

Souza's representatives have not responded to requests for comment from CNN.

No charges have been filed.

The Santa Fe County Sheriff's Office says it will discuss the case further at a news conference Wednesday.

Previous incidents on the set

There were at least two accidental props gun discharges on the set of "Rust" in the days leading up to the fatal shooting, according to multiple news reports.

The volleys occurred on October 16, when team members accidentally fired two shots after being told the gun was "cold," the Los Angeles Times reported, citing two team members who were allegedly witnesses to the incident.

It is not known whether the downloads included live bullets.

No one was injured in the accidental discharges, The Wall Street Journal reported.
