The Haifa District Court sentenced (Monday) 25 years in prison to Maamon Badarna, 37, of Araba, for the premeditated murder of his brother-in-law Zaid Asala, 38, who claimed he was not a man if he raised a hand against his wife, the deceased's sister.

The late brother-in-law, Zaid Asala, 38 at the time of his death, left behind parents, siblings and of course a widow and children. The youngest of the children was only two months old when he was murdered and he will not get to know his father and the eldest among them was 10. "I hurt what happened. I did not plan this thing and it's like my brother. He invited me and was nervous," said Madonna As punishment for the panel of judges Avraham Elyakim, Tamar Neot Perry and Ronit Bash, who ruled that it was proven beyond a reasonable doubt that he attacked the deceased and that he stabbed him intentionally, and not in self-defense. They noted that this conclusion is based on the evidence in the case, as well as on what they called "the defendant's inconsistent and unreliable version, and his impossible demonstrations."

Defense attorneys Adv. Yoni Dadon and Adv. Limor Dadon noted a settlement agreement between the families and that almost immediately after the incident, regardless of the outcome of the trial, compensation of NIS 750,000 was paid to the family of the deceased. Against this background, the prosecution did not request additional compensation in court.

The incident took place three years ago, on November 23, 2018, against the backdrop of the confrontation that Badarna had early that morning with his wife Loris, after which he left for his parents' house. At 6:58 a.m., Badarna received a phone call from the late Masala, who was working at the time at a gas station located a few hundred meters from Badarna's parents' house. He asked him to come and talk to him. Two minutes later, at 7:00, he had already arrived in Darna in his vehicle at the gas station, carrying the knife with him, got out of the vehicle and went to the station office. A lawsuit developed between the two over the morning confrontation between Badarna and his wife, Asala's sister.

Badarna pushed Asala and knocked him to the floor, and while the deceased was lying, he leaned over him, pulled out the knife and stabbed him two times in the back. The two then got up, Asala threw at Madara a backstage in order to keep him away from him, and it tossed back a chair that was in place. At this point, a man who had arrived at the gas station a few minutes earlier separated them. He kept Badarna away from the office and escorted him to his car, still holding a knife. Badarna got in his car and drove away, while brother-in-law Asala collapsed in the office. He was evacuated by ambulance in critical condition and died of his wounds shortly after arriving at the Galilee Medical Center in Nahariya.

The police investigation was conducted in the Central Unit of the Northern District. Investigators seized security cameras and obtained videos documenting Maamon Badarna arrives at the gas station and leaves her holding a knife in his hand. Dozens of witnesses were questioned using technological means.

"The case before us is a difficult and painful demonstration of the unbearable ease with which a trivial dispute turns into a fatal event," prosecutor Adv. Lilach Tamir, who sought to impose a life sentence on Darna, argued. On the gravity of the case. "

She added," I have been appearing in murder cases for many years and as the years go by I realize that there are not really enough words to describe the pit left in the life of a family that lost a loved one in such unnecessary death. I do not know if aggravated punishment is the only solution to the growing number of victims from year to year and probably not. "It is clear to me that only integrated treatment of all the systems of the country may be able to deal with this difficult phenomenon, but this does not reduce our responsibility to do everything we can to convey the message that such death is intentionally sentenced to life imprisonment and only in special circumstances."

She said, "Although we have no claim that the defendant planned to commit the murder in advance since if he had done so it would have been a murder under aggravated circumstances, but it cannot be ignored that the background to this incident, an argument of a few seconds, charged as it may be, leads the defendant to push the deceased. "Above him and stab him twice in the upper body with fatal stab wounds."

"Many mistakes have been made in this case," defense attorneys say, "appealed to the Supreme Court."
