AWO subsidiary: Judgment on the ex-managing director's complaint

After the Regional Court of Erfurt found the action of the ex-managing director of an AWO subsidiary to be inadmissible in September, the decision in the case is to be announced today, Wednesday (12.00 p.m.). Until then, the court had given the plaintiff the opportunity to amend the complaint. The former managing director of the Arbeiterwohlfahrt subsidiary AJS gGmbH, Michael Hack, had sued against his dismissal in 2020.

Until then, the court had given the plaintiff the opportunity to amend the complaint. The former managing director of the Arbeiterwohlfahrt subsidiary AJS gGmbH, Michael Hack, had sued against his dismissal in 2020.

Erfurt - According to the presiding judge, the lawsuit should not have been directed against the new management, but against the supervisory board.

The procedure had previously been referred to the regional court by the labor court.

This was justified by the fact that a complaint by a managing director against a GmbH is not a typical employee relationship according to the Labor Court Act.
