A fatal medical accident occurred in DR Medical Beauty Group 9 years ago. After a 46-year-old female customer received a CIK treatment which claimed to enhance immunity, she died of bacterial infection. Two other female customers who also received the treatment were injured and one of them had to be amputated.

The female doctor involved in the case, Mai Yunling, was convicted of manslaughter after a retrial and was sentenced to 3.5 years in prison.

She was dissatisfied with the conviction and filed an appeal. Today (27th), at the appeal permission hearing, the trial judge made a mistake in guiding the jury, causing injustice. The judge adjourned the verdict after hearing the submission.

She was previously ruled to kill Chen Wanlin (also known as Chen Ailian, 46 years old) in Hong Kong along with Zhou Xiangrong and Edison Chen due to serious negligence.

At the first trial of the case, the jury failed to reach a valid verdict, but she was found guilty after the case was retrial.

Mak Yunling claimed that the trial judge did not instruct the jury to reach a majority verdict on all elements of the charge

The co-founder Zhou Xiangrong and the male laboratory assistant Chen Guanzhong were convicted of manslaughter in 2017. Among them, Zhou was sentenced to 12 years in prison and Chen Ze was sentenced to 10 years in prison.

The two appealed earlier, and the appeal has not yet been issued.

On behalf of Mai, the trial judge did not instruct the jury to reach a major verdict on all elements of manslaughter. He believed that the jury had a chance to agree to only some of the elements, but not all, and that it might cause injustice to the defendant.

Furthermore, the prosecution amended the charges before the retrial, making the details too cumbersome.

The prosecution believes that the evidence in the case is sufficient, and amendments to the charges can clarify the relevant allegations.

After hearing the submissions of both parties, the judge adjourned the award of the verdict next month.
