From February 18 this year, the government requires all Category B restaurants to ensure that customers must scan "Travel with peace of mind" or register their personal information before entering. As of August 31, the Office of the Personal Data and Privacy Commissioner has received a total of 20 complaints.

From February 18 this year, the government requires all Category B restaurants to ensure that customers must scan "Travel with peace of mind" or register their personal information before entering.

As of August 31, the Office of the Personal Data and Privacy Commissioner has received a total of 20 complaints about restaurants failing to properly handle customer registration data. The Office has investigated 14 restaurants and requested corrections.

Among them, 8 restaurants, including Triple O's in Admiralty and Sadness Hot and Sour Noodles in Mong Kok, were accused of requiring customers to use a shared registration form.

The Privacy Commissioner has issued enforcement notices to all the restaurants involved, requesting appropriate and feasible data security measures.

The Commissioner’s Office received 20 complaints about failing to properly handle "paper" and 14 complaints were established

Of the 20 complaints received by the PCPD regarding the failure to properly handle customer registration data, 6 were unsubstantiated after preliminary investigations, and the remaining 14 have requested corrections.

One of the cases involved the big-corner mouth "Niu Ji". The complainant stated that he needed to fill in information on a piece of A4 paper with multiple squares, and the complainant had to register on a piece of A4 paper with multiple squares.

Niu Ji explained to the Office that he would cut the designed A4 paper into multiple independent notes for customers to use. However, the independent registration notes in the store were used up that day, and the clerk instructed the customers to fill in the information on the paper.

When the Commissioner’s Office dispatched personnel to inspect on April 26 this year, Niu Ji had a registration form of this design on the collection box, but there were only two blank squares on the separate registration note, which did not indicate the information items to be filled in.

The Privacy Commissioner pointed out that if restaurants temporarily use unopened forms for registration purposes due to poor arrangements, the situation is the same as sharing registration forms. The situation is unsatisfactory. Even if the registration notes are cut, the design is simple and there is no indication of what information to fill in. It also failed to inform customers of the purpose of collecting data.

The registration form shared by 11 restaurants including Triple O's in Mong Kok

According to the PCPD, 11 restaurants use shared registration forms or registration books for customers to fill out at the in-store registration office, including Mong Kok Sad Hot and Sour Noodles and Admiralty Triple O's.

The Privacy Commissioner stated that the shared registration box allows registered customers to view earlier registered information and the content of other pages. This is absolutely undesirable. Even if the restaurant adds a cardboard to cover the content of the registration form, it is caring. It is also easy to remove the jammed paper for inspection, which violates the provisions of the data protection principle.

The collection box of Hanteng Court in Taikoo Shing is not covered with the Office: Those who are interested can easily take out the form

The Hanteng Court in Cityplaza was also complained that its form collection box was not covered. Hanteng Court explained to the Office that it was believed that the staff had forgotten to cover the collection box after clearing it.

The Commissioner’s Office believes that if the collection box is not properly closed, people who are interested can easily reach into the box to remove or discard the forms. There are obvious loopholes.

Kwai Fong Tan Tsai did not provide a form collection box, only the staff to collect customer forms

The Tan Tsai Yunnan Rice Noodle in Kwai Fong did not provide a form collection box, which was collected by the staff. The PCPD stated that if the store staff did not put away the customer form for a long time, the information would have the chance to be checked by a third party passing by.

Privacy Commissioner: The privacy risk involved in filling in paper is greater than "traveling with peace of mind"

14 restaurants have taken remedial measures, and the Privacy Commissioner has also decided to issue enforcement notices to all the restaurants involved.

The Privacy Commissioner pointed out that members of the public should pay attention to the privacy risks associated with providing personal information to different restaurants, saying that replacing “travel with peace of mind” with a "paper-filled" method may require providing personal information to different restaurants every day. Hidden risks are relatively greater than "travel with peace of mind".
