The State Attorney's Office wants to sentence Arie Schiff to 6-4 years in prison Israel today

The Be'er Sheva District Court this morning (Monday) is hearing the sentence of Aryeh Schiff, who was convicted of killing Muhammad al-Atrash who broke into his car in November last year in Arad.

The decision on the sentence is expected to be made on Sunday next week.

Schiff's conviction was obtained after a mediation procedure between him and the State Attorney's Office, in which the parties agreed on a conviction lightly, recognizing that Schiff had the right to self-defense.

His family, Lash al-Atrash, also agreed to the agreement.

However, in the agreement reached between the parties there was no agreement on the sentence to be imposed on Schiff and the prosecution seeks to impose on him between four and six years in prison.

"The defendant's actions were intentional and conscious," prosecutors said during the hearing. "We concluded that this was not negligence and indifference, but frivolous conduct."

"He is not the kind of person who is indifferent to human life and the situation he was in is a difficult situation and it is a pity that we are here but that is the situation. We as a country should not infringe on the value of sanctity of life.

The court criticized the prosecution's approach, and court president Revital Yaffa Katz, who heads the judging panel in the case, said the request for a four-year prison sentence was "contrary to the dynamics of mediation," noting that she was surprised by it.

Schiff's attorney, Shashi Gaz, argued that Schiff's sentence should be commuted following the difficult situation he was in.
