The chairman and lawyer of the "Hong Kong People's Rights and People's Livelihood Party," Xiao Sijiang, filed a lawsuit in the High Court in the name of the company, requesting a ruling that Hong Kong has the right to sue the Taiwanese homicide suspect Chen Tongjia for murder.

Senior Counsel Tang Jiahua, a member of the Executive Council, said that he respects anyone's right to lodge a complaint with the court, but the relevant provisions do not seem to be applicable.


Tang Jiahua believes that the Chen Tongjia case occurred in Taiwan, and Taiwan has a jurisdiction, and all the evidence in the case is also in Taiwan. Therefore, there is little chance that the Hong Kong court will be able to try the case.

The complaint stated that the deceased woman was a Hong Kong citizen. According to Article 19 of the Criminal Procedure Ordinance, “committed crimes on the high seas or anywhere outside Hong Kong”, Hong Kong has jurisdiction over the case. Therefore, the Department of Justice should be able to Hong Kong sued Chen Tongjia, and the local courts also have the power to deal with it.

The petition also stated that Taiwan could execute the death penalty, while Chen Tongjia was convicted in Hong Kong, and he would be saved from one death.

Tang Jiahua stated to "Hong Kong 01" that he respects anyone who holds any grounds to lodge a lawsuit in the court, but according to his understanding, Article 19 of the Criminal Procedure Ordinance is mainly applicable to the high seas or other places without jurisdiction.

However, the Chen Tongjia case occurred in Taiwan. Taiwan has a jurisdiction and all the evidence in the case is also in Taiwan. Therefore, it is believed that the Department of Justice has little chance of prosecuting Chen Tongjia in Hong Kong with this provision.

Chen Tongjia was released from prison for money laundering crimes in October of the previous year. He publicly stated that he was willing to surrender to Taiwan, but he has not yet done so.

Last month, the mother of the deceased Pan Xiaoying invited Chen Tongjia, Security Bureau Director Deng Bingqiang and others to publicly confronted the government, but no one responded. The Security Bureau later stated that the case occurred in Taiwan.
