The Haifa District Court yesterday (Wednesday) sentenced Rafi Shroff, 23, of Isfahan, a security guard at the Ma'ale HaCarmel psychiatric hospital in Tirat Carmel, to four years in prison, after committing sexual offenses in a 13-year-old hospital in January. Brother Edward Kachura, the suspect in the murder of Yael Melnik is hospitalized at the age of 17.



"It is not disputed that the defendant's actions are serious," the panel of judges ruled.

Justices Yechiel Lifshitz, Galit Ziegler and Shmuel Mandelbaum mentioned that this was someone who, during his work as a security guard at the hospital, developed a sexual, forbidden and criminal relationship with the girl who was hospitalized there, knowing her age.

During the trial, he claimed that Shroff "developed feelings towards the girl and had intentions to develop a relationship with her." Lifshitz mentioned that this is not a "one-time stumble," but a series of actions. He emphasized that it was a young girl and that the acts were carried out in a mental health center, when the girl was hospitalized at the place where the young man served as a security guard. "This latest combination of data gives the case before us its remaining severity, even in relation to other cases," he stated. "He knew it was a mental background. Shroff was interrogated at the Tirat Carmel station where he admitted to having sex with the girl, and was released. He was later summoned for questioning, and arrested. An indictment was filed in February. Even before the evidentiary phase began, he confessed to the acts through his defense attorney, Adv. Michael Carmel. The



prosecution sought to sentence the security guard to six to ten years in prison. "It will be emphasized that if it were not for the defendant's confession and all the other data available to him, including his participation in a treatment procedure, his sentence would have been heavier and longer," Judge Yechiel Lifshitz clarified.



The girl's mother described to the court severe feelings of insecurity and mistrust in the frameworks of care and supervision since those events, for as she said, the injury was in a place that was supposed to provide her daughter with care, supervision and protection. The mother added: "The incident was experienced for the family as traumatic, and since the injury the parents feel the need to look after their daughter closely, and this leads to family tensions and difficulties."



A review of the girl's case was submitted to the court stating that the abusive sexual relationship was prolonged and left her with scars and damages that characterize sexual victims in general and children in particular. The girl told the editor of the survey that she had lost faith in caregivers and authority figures, and had even lost faith in her family and people in general.



Shroff told the judges: "I'm very sorry I hurt the girl and I'm ashamed. I also did shame to my family. I gave everything I could to recover and I want to recover. I ask that I can continue my life properly after I recover."

In addition to the actual prison sentence, the judges also sentenced Rafi Shroff to a suspended sentence of 12 and eight months for three years, and also ruled that he would pay the girl compensation in the amount of NIS 40,000.



It should be emphasized that Ma'ale HaCarmel Hospital has been in the process of preparing for unification into the director of the psychiatric ward at the Human Health Medical Campus, Rambam in Haifa, a move that is estimated to happen in 2022.
