2021-11-09T21:19:52.447Z

The family has reached an agreement with the Jewish owners on the evacuation of the house in the Shimon Hatzadik neighborhood, but will be able to live in it for at least a decade • Meaning: A blow to the Palestinian Authority and Hamas, who want to prevent similar arrangements

While the parties to the struggle over the homes of the Jews in the Shimon Hatzadik neighborhood - Sheikh Jarrah are awaiting the Supreme Court's decision regarding the fate of the Arab families living in them - an Arab family from Shimon the Tzaddik reached an agreement with the Jewish owners of the house where she lives.

Under the arrangement the house will be evacuated, but only in many years.

It should be emphasized that the family in question is not part of the appeal filed by Arab families from the Shimon Hatzadik neighborhood to the Supreme Court, against the district court's decision to evict them.

The arrangement, which a few days ago was given the force of a final ruling in the Jerusalem Magistrate's Court, may also serve as a precedent for other Arab families.

It is considered a blow to the PA and Hamas, which are putting a lot of pressure on the Arab residents of Shimon HaTzadik - Sheikh Jarrah, not to reach understandings and arrangements with the Jewish owners of the houses there. Of the High Court to recognize Jewish ownership of the houses in which they live, but to remain in them as protected tenants, even though some of the families were willing to do so.

The arrangement concerning the house in the Shimon Hatzadik neighborhood, which is reported here for the first time, deals with an Arab family that has lived there since 1956. The arrangement was reached after the Jewish owners applied to the court and demanded its eviction.

The arrangement stipulates that the guarantors who live in the house will pay rent to the owners, and will be able to continue to hold it "until the end of their lives", but without the right of protected tenants.

It was further stipulated that if the Jewish owners received a building permit for the house, they would provide alternative housing for the Arab family.

In any case, it was agreed, "the eviction will not be carried out before the lapse of 10 years from the date of validity of the judgment for agreements between the parties."

One of the main clauses in the agreement clarifies that the rights of the Arabs at home today cannot be transferred to any other party, including their children or anyone from their family.
