- Always follow your nose when the police were working in the “Kiffer-WG” in February. Witnesses in front of the regional court on Wednesday named the shared apartment that had rented in a former farmhouse in Freising. The smell of cannabis wafted towards them on the second floor, according to a police officer. Only one door was open. A look through this was enough to see cannabis and drug paraphernalia on the table. Because a survival knife was later found during the search, its residents now had to answer for unauthorized armed dealing with narcotics in no small amount before the criminal chamber. After the taking of evidence had revealed no evidence of drug deals,the 33-year-old got away with a conviction only for possession.

Following the requests of the public prosecutor's office and defense, the chamber imposed a two-year prison sentence, which was suspended. The man was ordered to take part in addiction counseling sessions. The previously innocent chemical laboratory technician had been in custody for nine months after the incident. At first, drugs were not an issue during the police operation on February 13th. The corona rule applied to two households. A neighbor had called the police and complained that the farmhouse was constantly having parties. After the caller reported 15 to 20 people and a large house, several strips had broken into. On site, according to a police officer, there would have been an "exuberant party atmosphere". Because you could already smell cannabis through the open door,it was decided to position all colleagues at certain points. When the celebrants noticed the uninvited guests, some of them jumped out the window and fled. Criminal proceedings were later initiated against seven people for possession of narcotics.

The police had seized 322 grams of cannabis in the defendant's room. Due to the large amount and the knife, a procedure for trading in weapons was initiated against him - the arrest took place. "The situation was relatively clear," said presiding judge Ralph Reiter in the reasoning for the verdict. The 33-year-old had asserted in court that the large amount was only intended for personal consumption. He justified the fact that there were different batches with the desire for variety: They were different varieties - “and each one has a different effect”. After there was no evidence, apart from the unusually high amount, that the accused was “the big dealer”, prosecutor Thomas Kunze was ultimately only a criminal offense of possession.“The initial suspicion remained,” said Reiter. For the 33-year-old, it was "a wake-up call," as he said. He has not wanted to smoke weed since that night. The judgment is final. (
