A video that someone from Dorfen sent to a WhatsApp group costs him 2500 euros.

Dorfen / Erding - Almost everyone has WhatsApp groups on their mobile phones. One of them is a 25-year-old from Dorfen. Because he had already uploaded a film sequence in a mass group three years ago in which a car with a swastika on the hood and door and people with a Hitler salute can be seen, he had to answer before the Erdingen district court yesterday. In the end, he withdrew his objection due to hopelessness and thus accepted the fine of 50 daily rates of 50 euros each. In the negotiation chaired by Judge Michaela Wawerla, however, it also became clear that the Dorfener is probably not a right-wing radical or a neo-Nazi.

Jakob Carl from the Landshut public prosecutor's office accused the young man of uploading the film, which could have come from South America, on October 1, 2018.

Because of the use of symbols of unconstitutional organizations - including swastika and Hitler salute - the Dorfener received a penalty order for 2500 euros.

He appealed against that.

What is remarkable about the case is the WhatsApp group with at times 1400 members.

The investigating detective chief commissioner from the Traunstein detective reported that "it was mainly about all kinds of youth issues".

However, numerous entries with criminal penalties were found, said the 53-year-old.

Judge Wawerla reported at least 20 criminal cases.

According to the detective, they had found out about the Dorfener by securing a third party cell phone.

Child pornographic files were found on it.

The public prosecutor's office in Bamberg, responsible for these offenses, had the mobile phone evaluated - and so came across the Nazi video of the Dorfener.

The assured that he was by no means a right-wing man.

“I can't remember the video, but I can't rule out that I uploaded it.” There were several hundred posts in the group every day.

"If that was me, it was more from satire, but certainly not from right-wing belief," he said.

His defense attorney, Veronika Schönsteiner, wanted the proceedings to be discontinued.

"My mandate has had a straight career and has never been guilty of anything." She considers it inappropriate to condemn the accused for a one-off stupidity.

Because of the memory gaps and the 25-year-old's advice that he could not find the video in the chat, Wawerla offered to have his mobile phone evaluated.

But she warned him that it would be very costly.

Otherwise she and Carl refused to drop the case.

The charge is too heavy for that.

Finally, the defendant withdrew his objection.

With that he pays the 2500 euros, but also has an entry in the federal central register.
