The “Yellow Shop” restaurant in Kwun Tong sold the “self-rescue masks” that Hong Kong Zhongzhi (disbanded) was responsible for packaging last year. Customs sent officers to the shop to “release snakes” to buy 6 boxes of masks and take the masks for laboratory tests. It was found that the batch of masks did not comply with the instructions on the packaging, and the restaurant and its person in charge were charged afterwards.

The two defendants pleaded guilty to supplying false trade description goods in Kwun Tong court through their lawyers today (11th) and were fined $20,000.

The two defendants: Chaohua Xishi Co., Ltd., and its director Leung Pak Ho, were each charged with one count of supplying goods to which false trade descriptions have been applied, alleging that they had been in Kwun Tong Kailian Industrial Centre on April 21, 2020. In the unit, there was a false product description, namely "ASTM Level 1" surgical masks, and they were supplied for commercial use.

Customs releases snakes and buys 6 boxes of masks

According to the prosecution plan, customs officers used snakes to buy 6 boxes of "self-rescue masks" at the unit involved in the case for HK$600.

After testing, it was found that the batch of masks did not reach the "ASTM Level 1" protection level stated in the packaging, which was a false product description.

Liang admitted that he bought the goods from the "Sprint Co., Ltd." related to Hong Kong Zhongzhi, and he has not taken any measures to confirm that the masks meet the specifications stated in the packaging.

Zhongzhi related company has pleaded guilty and fined earlier

The defense pleaded that Sprint had previously admitted to possessing 935 boxes of the same masks and was only fined HK$10,000. The number of substandard masks involved in this case was far less than Sprint. In addition, the defendant had already removed the relevant goods from the shelves after the incident. The officer finally imposed a fine of 10,000 yuan for each of the two subpoenas, that is, the company and the person in charge were fined a total of 20,000 yuan.
