Neighbors have to accept a slight superstructure on their property for subsequent thermal insulation - this applies at least to old buildings, the Federal Court of Justice (BGH) decided on Friday in Karlsruhe.
New buildings would have to be planned in such a way that the thermal insulation remains within the boundaries of your own property.
The highest German civil court made it clear at the same time:
Karlsruhe - The federal states are allowed to regulate cross-border thermal insulation (Az. V ZR 115/20).
Energy should be saved with the energetic building renovation;
In view of climate protection, this is in the general interest, according to the BGH.
The Karlsruhe judges ruled on a case from Cologne.
There, neighbors got into a fight because of the planned external insulation of an apartment building that stands directly on the property line.
According to North Rhine-Westphalian state law, the neighbor must tolerate the superstructure if comparable thermal insulation is otherwise not feasible with justifiable effort and the development does not impair his property or only negatively impacts it.
Anything protruding below 25 centimeters is therefore fine.
