Franck Lavier, one of the acquitted of Outreau, appealed against his dismissal before the assizes of Pas-de-Calais for facts of "
rape and sexual assault
" on one of his then minor daughters, we have learned Monday from his lawyer.
Fabienne Roy-Nansion, counsel for Franck Lavier, confirmed on Monday that she had appealed the indictment order.
"
There is nothing in this file other than the word of one against the word of the other,
" she told AFP, stressing "
a constant denial
" by Franck Lavier of facts for which he is accused.

The prosecutor of the Republic of Boulogne-sur-mer Guirec Le Bras had announced Friday the "
referral to the Assize Court of Franck Lavier for acts of rape and sexual assault
", without giving further details. The case began in 2016 with a report from the National Education sent to the prosecution, "
reporting revelations of sexual assault on young C., aged 16
", according to statements from the prosecution to the era. According to a source familiar with the matter, the prosecution finally requested in this case, last July, the referral of Franck Lavier to the criminal court for acts of sexual assault, committed between September 2014 and May 2016.

Franck Lavier, for his part, has always contested any aggression against his daughter.
Now 43 years old, Franck Lavier was with his wife Sandrine one of the accused in Outreau.
He was acquitted by the Paris Court of Appeal in 2005, after being sentenced in 2004 to six years in prison for the rape of his stepdaughter and sexual assault on four children, by the Assize Court of Saint -Omer (Pas-de-Calais).
