New mandatory vaccination decree for employees in Puerto Rico

The governor of Puerto Rico, Pedro Pierluisi, announced this Monday the signing of a new decree against covid-19, in which the vaccination of workers in private companies and government municipalities with 50 employees or more.

In the event that an employee is not vaccinated, they will not be required to present any exceptions, religious or medical, and they will have the option of submitting a negative covid-19 test result at least every 7 days.

The decree also orders the vaccination of students over 5 years of age. They must be vaccinated on or before January 31 to take face-to-face classes. Students over 12 years of age who have a medical or religious exemption to not be vaccinated must take a test every seven days in order to be in class in person. Those students between 5 and 11 years old who have an exemption will not need to take a covid-19 test and can be in person. The statement indicates that the Department of Health can conduct random tests, as it sees fit. All students who are not vaccinated before January 31 will only be able to receive classes virtually.

"In order to avoid significant increases and in view of the festivities that are approaching, it is necessary to maintain certain measures and include other affirmative actions in more vulnerable sectors in order to maintain the low trends that have made us an example for other jurisdictions," said Pierluisi in a press release.

Minors may attend mass events in closed places until January 31 with a negative covid-19 test result carried out 72 hours before entering the establishment.

As of February 1, these minors will be governed by the provisions that apply to adults.

The previous provisions will not apply to public or religious events in which government services or a dispensation from the Department of Health are provided.

Mandatory use of a mask

The new decree maintains the use of a mask in activities with 50 people or more outdoors and is recommended in tourist places in urban areas where there are crowds. This mask requirement does not include beaches or resorts. The Puerto Rico Department of Health may also require the use of masks in other settings that it determines to be appropriate. The use of a mask will continue to be required in closed places as before. For private meetings of 20 people or less, in which everyone is vaccinated, the mask will be recommended but not mandatory.

Regarding mass activities in closed places, it is maintained that all people must be vaccinated so that the establishment has 100% occupancy;

For establishments that only request the negative test, the capacity will be limited to 50% occupancy.
