Lament that the pan-people misunderstood the Basic Law and adopted "extreme confrontation" in one country, two systems

Li Haoran said that Hong Kong is a common law area, focusing on the text of cases and legal provisions; the mainland interprets constitutional documents based on the principle of "statutory law", attaching importance to the overall environment, the context of the entire law, and the original intent of legislation.

The distinction behind is quite complicated, but these two interpretation directions have caused many contradictions since the return. From the disputes about the right of abode in the case of Wu Jialing to the political contradictions mentioned above, they all show the different interpretations of the two legal provisions. .

However, he believes that these contradictions themselves can be reconciled through mutual understanding and communication, because the original intent and spirit of "One Country, Two Systems" and the Basic Law also include the closer and running-in of the two legal systems. "One country, two systems" after 2047 "will definitely continue to exist"

Li Haoran also pointed out that although Article 5 of the Basic Law refers to "the Hong Kong Special Administrative Region does not implement a socialist system and policies, and maintains the original capitalist system and way of life for 50 years." But this does not mean 2047. Hong Kong's system will change after a year. "I can say with certainty that "one country, two systems" will still exist after 50 years (of the reunification)."

Li pointed out that the "recognition movement" in the late 1970s in China deeply understood that socialism and capitalism were only "tools" after all, not a "target", that is, the "black cat and white cat theory" that everyone heard later. As long as the country can be prosperous and strong, national rejuvenation, and people's lives improved, the two systems will definitely learn from each other's strengths.

For this reason, among the 14 basic strategies proposed by the 19th National Congress of the Communist Party of China, they include "adhere to "one country, two systems" and promote the reunification of the motherland."

He explained: "This is exactly the fundamental concept that Deng Xiaoping put forward at the time of "One Country, Two Systems". I don't see why Hong Kong will not continue to practice capitalism after 2047. This is not the Cold War period, and there is no longer the ideological disputes of those years. As for the issue of "revision of the law," Li Haoran agrees that when a constitutional document is drafted, there must be some things that were not foreseen.
