The Peleg family, the family in Israel of six-year-old Eitan Biran, who survived the cable car disaster in Italy, today (Wednesday) appealed to the Jerusalem Supreme Court against the decision to return him to his father's family in Italy.

This, after last week the district court rejected the appeal of his grandfather, Shmuel Peleg, the father of the mother who perished.

The Family Court ruled that Eitan was abducted from Italy to Israel, and that he must return to his usual place of residence in Italy.



The family statement said that the appeal was made "in the hope that they will give Eitan and Euro an appropriate response to his immediate examination by professionals and clarify his will and true good.

In its decision last week, the district court ruled that Biran would be returned to his home in Italy within 15 days, thereby expressing his support for the Family Court ruling that his place of residence is not in Israel but in Italy.

"With all understanding for the pain of the minor's grandparents, there is no escape from dismissing the appeal," the Tel Aviv District Court judges wrote.

Shmuel Peleg will bear the legal costs, amounting to NIS 50,000.



The Biran family's attorneys, Shmuel Moran and Avi Chimi, welcomed the ruling: "We hope this is the last step before Eitan returns to his family and home in Italy."



On the other hand, the Israeli Peleg family said that "we can only regret the verdict. Eitan is an Israeli and Jewish child whose late parents would like him to continue to grow up and develop in Israel. Unfortunately, once again Eitan's voice and will remained outside the courtroom."
