Moosburg / Landshut - small children and drugs under one roof - that is "an extremely bad combination", as a Moosburger (33) admitted on Monday in front of the Landshut regional court.

Nevertheless, the man had kept a colorful variety of drugs in his apartment in Freising in the living room cupboard.

According to the extensive confession of the 33-year-old, part of it was also intended for profitable resale.

At the beginning of the trial, he was silent on other charges, such as drug sales to minors and the order of almost 253 grams of amphetamine.

In the end, the fourth criminal chamber sentenced him, including a ruling by the Freising District Court, to a total imprisonment of two years and, due to a temporal break, to a further imprisonment of one year and nine months.

Denial would have been pointless

For those involved in the proceedings, however, the focus was on placing the addict Moosburger in a rehab facility.

On the advice of the district court doctor, who certified the 33-year-old as having polytoxicomania, as well as at the request of the public prosecutor and the defense, this was ordered.

Denial would also have been pointless: during a search on the morning of March 16 in the Moosburger's apartment and in two cars that were both parked in front of the house, the police had found a total of 108 grams of marijuana, 0.9 grams of a tobacco-marijuana mixture, 342 grams of Speed, 39 ecstasy tablets and 7.3 grams of MDMA were ensured.

His fiancée had nothing to do with it, he had assured the officials on site - and also emphasized in court on Monday.

He now wants to keep his hands off drugs for her and his family.

According to the original charges, he had been extremely active in the drug scene from at least January 2020 until his arrest after the home search.

After the end of the investigation, the public prosecutor charged the 33-year-old with 29 cases of unauthorized trading and the unauthorized supply of narcotics to minors and two cases of unauthorized trading in drugs in significant quantities.

A few points were dropped in court, however.

The defendant was targeted by the investigators when he ordered Speed ​​at the beginning of 2020, which, however, never reached him: Wuppertal police officers intercepted the package addressed to his mother. According to witnesses from the scene, the defendant had a lively trade in narcotics in the Freising area. He is said to have sold weed to a 17-year-old every week. He is said to have given an 18-year-old 33 grams of speed for a cell phone. Chats about drug deals with the defendant were found on the witnesses' cell phones.

Since then, the cell phone has been blocked and the Moosburger has not revealed his PIN.
