Playgrounds in residential complexes are becoming mandatory: The Free State has stipulated this in its amended building regulations, and the City of Erding is now implementing it in its statutes.

Town hall lawyer Andreas Erhard is particularly pleased that the city administration can report an initial success just a few days after the preliminary discussion of the statutes in the urban development committee.

On Tuesday, he announced to the planning and construction committee that the investor in the Haager Straße / Hennengasse building project (formerly Möbel Falterer) had withdrawn his application for a playground replacement and would rather build an 85 square meter indoor playground because there was no open space on the site gives.

“We were assured beforehand from all sides that a playground is not structurally possible there - and lo and behold: it works,” said Erhard.

That it works is probably also due to the fact that the fee for the playground here would have been around 760,000 euros according to the draft statutes.

"According to the investor, the playground allegedly costs less than half the transfer fee," said Erhard.

According to the draft statutes, this is based on the newly created living space - here a good 1400 square meters.

A 1.5 m2 playground is required for every 25 m2.

That makes 85 square meters.

Multiplied by the standard ground value and the number of floor areas, you get the transfer fee.

Even if the city administration found the amount to be high, Erhard emphasized with reference to other municipalities: “We are on the average here.” In the statutes, both indoor and roof playgrounds should be included in principle.

This was suggested by Herbert Maier (Greens).

At the end of November, the city council wants to pass a resolution on the statute.

Hubert Sandtner's (CSU) objection that the standard land value is too high, the transfer fee will be passed on to the residents and make it even more expensive for them, may not apply to Mayor Max Gotz (CSU). The standard land value is the cheapest value that can be used. “We all know that much higher prices are currently being charged.” Erhard emphasized that for reasons of equal treatment of builders who build a playground, one could not go below the standard land value. "It is an attempt to find a just and fair solution," said Gotz and reminded that "we did not make this law, but the state parliament".

City architect Sebastian Henrich explained what is behind it.

He spoke of a dilemma due to the dramatically reduced spacing between buildings, which has been in effect since the beginning of the year (40 instead of 100 percent of the wall height).
