The public prosecutor's office is accusing the 21-year-old of wanting to sell the grass because he and three other people were found on Tegernseer Strasse.

None of them had any drugs with them.

The householder had the 4.7 grams of marijuana with him in several small bags, which in turn were in a larger bag.

He did not want to comment on the charge.

"My client makes use of his right to refuse to testify," explained defense attorney Max-Josef Hösl. So it was up to the witnesses to clarify this process. "A colleague and I were out in civilian clothes and carried out an identity check on the group of four to five men," says a 24-year-old officer from the Miesbach police station. He noticed how the defendant dropped a package "from his pants or jacket pocket directly behind him". "I saw it exactly, but he said it was not his package," said the officer. The bag would have contained 4.7 grams of marijuana. "Since there were several small bags, each weighing around one gram, in the big bag, we immediately thought of trading," added the 24-year-old.In addition, the defendant is "well known as a narcotics dealer".

Another indication in the eyes of the police officer is "that he had many ten-euro bills in his wallet". In many places a gram of marijuana is sold for ten euros, he said.

"The trade is only a suspicion," interjected attorney Hösl and, according to his testimony, did not want to dismiss the police officer without swearing.

Before doing this, he wanted to know what the other witnesses would say.

These were the three young men who had to face the identity check together with the defendant.

"I don't know what exactly happened there," said a witness (19) from Hausham.

During the inspection, he meticulously "paid attention to my notebook that the police officers put on the sidewalk," said the householder.

He does not want to have seen that the accused dropped a bag of grass.

“We met there by chance and did not agree to go into a marijuana trade,” said the witness, who, according to his own statement, “never carried cash” with him.

The second witness from the group of four also stated that he did not see any drugs on the 21-year-old on that day. "Apparently they found something with him because they took him with them," said the householder (23) about the defendant. "I don't know whether the police found anything - at least not from me," said the third witness (20), who also comes from Hausham.

Judge Walter Leitner stated, mainly because of the police officer's testimony: "It doesn't look particularly rosy." After consulting his lawyer, the accused did not want to confess. "I apologized to the police officer for my wrongdoing," added the 21-year-old. By that he meant his temperamental behavior towards the officers. "He apologized," replied the policeman. "But we didn't accept the apology because I've never seen anything like it."

There has not yet been a conviction.

Hösl demanded an expert report for the fingerprints on the marijuana bag and the statement of the second police officer, who was prevented this time.

But only the second wish is fulfilled - at the end of November there will be continuation negotiations.

Then it will show whether the househammer, who has eight criminal records, has really finished his drug career.

He said so.
