The Independent Commission Against Corruption yesterday (17th) sued a former manager of a cleaning company and two cleaning subcontractor operators, accusing them of involvement in the floor maintenance works of four shopping malls, fraudulent service fees totalling about 3.5 million yuan, and handling The crime proceeds obtained from this hook totaled more than 3 million yuan.

The defendants were granted bail and will appear in Eastern Magistracy on Friday (November 19), pending the transfer of the case to the District Court for defense.

The defendant Chen Peiran (52 years old) is the former operations manager of Zener Service Co., Ltd.; Lin Zhihua (46 years old) and Zhu Derong (47 years old) are both operators of Junhua Service Co., Ltd.

Chen Peiran and Lin Zhihua were both charged with two counts of fraud, violating section 16A of the Theft Ordinance.

Lin Zhihua and Zhu Derong were both charged with a conspiracy to deal with property known or believed to represent the proceeds of an indictable crime, in violation of section 25(1) of the Organized and Serious Crimes Ordinance and the Criminal Offences Ordinance Section 159A.

According to the case, Zengli is a cleaning company that provides cleaning services for residential estates, offices and shopping malls managed by the same company, Kai Shing Management Services.

At the time of the incident, Chen Peiran was Zengli’s operations manager and was responsible for overseeing the four mall cleaning contracts managed by Kai Shing.

Chen Peiran recommended Zengli's subcontractor to implement floor maintenance projects. Through Chen's introduction, Junhua became Zengli's cleaning subcontractor in 2011.

Lin Zhihua and Zhu Derong are the operators of Junhua and the authorized signatories of the company's bank account.

The four shopping malls involved are managed by Kai Shing Management Service Company

Two of the charges allege that between January 19, 2015 and July 24, 2017, Chen Peiran and Lin Zhihua falsely stated that Junhua had implemented maintenance works of "renovating marble floors" for four shopping malls with intent to defraud Inducing Zengli and Qisheng to pay for the project, Chen Peiran and Lin Zhihua benefited, and Zengli and Qisheng suffered disadvantages.

The maintenance works involved more than 3.5 million yuan.

The remaining charge alleges that between January 19, 2015 and June 29, 2017, Lin Zhihua and Zhu Derong knew or had reasonable grounds to believe that a total of more than 3 million yuan in the Chun Wah Bank account, all or Partially, directly or indirectly, represents the proceeds from an indictable crime, while still conspiring to dispose of the property together.

The ICAC stated that it had initiated an investigation after receiving a corruption complaint. After completing the investigation, it sought legal advice from the Department of Justice and prosecuted the three defendants in accordance with the relevant legal advice.

Kai Shing and Zeng Li provided comprehensive assistance during the ICAC investigation.
