Berlin's Senator for the Interior, Andreas Geisel (SPD), appeals to the Constitutional Court against the result of the House of Representatives election on September 26th.
A corresponding brief will be submitted on Monday, a spokesman for Geisel told the German Press Agency on Friday.
The Senate Administration has the legal supervision of this election and can appeal if there are indications of irregularities that would affect the distribution of mandates.

Geisel had already announced in October that he would not rule out such a step because of various mishaps on election day, including missing or incorrect ballot papers and the temporary closure of polling stations.
The regional electoral committee had previously announced an objection to the Constitutional Court.
In 2 of 78 constituencies there were violations of the law that could affect the distribution of mandates, it said.
A repetition of the election is now possible in the two constituencies in Charlottenburg-Wilmersdorf and Marzahn-Hellersdorf.
The Constitutional Court must decide on this after examining the events.
