On Thursday, the Bundestag gave the go-ahead for the revision of the Infection Protection Act.

There are numerous changes also for companies and employees.

An overview.

Munich - In the fight against the corona pandemic, the Bundestag passed the amendment to the Infection Protection Act on Thursday.

This clears the way for a renewed obligation to work from home and 3G at work.

Now the amended law has to be passed by the Federal Council.

According to the plans, employers must enable their employees to work from home - provided there are no operational reasons to the contrary.

A corresponding regulation came into force last April, but expired at the end of June.

Now the regulations are to be put back into force.

For employees who cannot work from home, such as those in industry, the 3G rule is to apply in the workplace in the future.

In future, employees will only be allowed to enter the company if they have been vaccinated, recovered or tested and can provide proof of their vaccination status, explained Wolfgang Schelling, specialist lawyer for labor law at Noerr, on Thursday to

.

The regulation applies "regardless" of the size of the company and must be checked daily.

The new requirements could come into force on the day of their announcement, i.e. probably next Monday (November 22nd).

The 3G rule also applies to employees with changing workplaces, such as craftsmen or field workers, emphasized Schelling.

Corona rules for companies: At least two free tests

At the same time, employers are again obliged to provide unvaccinated employees with at least two free tests per week.

"Submitting a self-test is not enough," explained the specialist lawyer for labor law.

Instead, the corresponding survey must be carried out externally or via a supervised test in the company.

Compliance with the 3G obligation must be monitored and recorded by the employer.

In order to check the vaccination or test status, the employer can now also record the relevant data.

However, the draft law does not contain an explicit right to information * based on the vaccination status.

Schelling said that the employer was only allowed to record for which employees a daily test certificate was required "for lack of vaccination and recovery.

Corona rules for companies: Home office obligation is coming back

At the same time, the regulation on home office applicable at the end of June is to be reactivated.

After that, employers must again offer their employees to work from home.

However, this obligation applies as long as the operational process is not significantly disrupted.

Employees are generally obliged to accept the home office offer, but can refuse if the technology is not available or if they are disturbed at home.

A lack of space is also a reason for rejection by the employee.
