Theo case: the Paris Court of Appeal announces the referral of the police to the assizes

The main accused is dismissed for willful violence resulting in mutilation or permanent disability in the victim, injured in the rectal area during a check-up.


The police officers involved in the violent arrest of Théo Luhaka in 2017 in Aulnay-sous-Bois will be tried before an assize court, after the rejection on Thursday November 18 of their appeal before the investigating chamber of the court of call from Paris, AFP learned from a judicial source.

By decree, the investigating chamber "

confirmed the referral to the Assize Court

" of the police, said this judicial source.

The date of the trial is not yet known.

In November 2020, the investigating judge in charge of the investigation into the assault of this young black man, injured in the rectal area during a check, had referred these officials to the assizes for willful violence.

No case for the fourth policeman

Two of the three respondents subsequently appealed against this referral. The main defendant, aged 31, is notably expelled for willful violence resulting in mutilation or permanent disability in the victim. The other two, 28 and 39, will have to answer for willful violence with several aggravating circumstances. A fourth policeman, witness of the scene, benefited from a dismissal. Central issue of the case, the prosecution for rape had on the other hand been dismissed by the judge for lack of sufficient elements, according to a source close to the investigation.

On February 2, 2017, Théodore Luhaka, 22, was arrested in the city of 3000 of Aulnay-sous-Bois (Seine-Saint-Denis), a scene filmed by video surveillance.

While the police tried to immobilize him, the young man struggled and then collapsed, before being moved a few meters, out of the field of the camera.

Five days after the facts and the wave of indignation which followed, the young man had received a visit to the hospital of François Hollande, then President of the Republic.

Seriously injured, he suffered irreversible consequences.
