Nuremberg - Anyone who wants to take part in face-to-face lessons must regularly take a corona test.

Parents who want to spare their offspring this do not send them to school.

Just recently, a Schwabacher * pupil from Adam-Kraft-Gymnasium made headlines.

Since the beginning of the 2020/21 school year, he has refused to take part in the school's internal corona tests * and thus in face-to-face classes.

That could soon have consequences. 

Because all efforts of the school failed to get the 17-year-old to return, the director informed the student that the school had to equate his absence with a "declaration of resignation".

The boy now has to decide within a period whether he wants to come back.

A decision will be made on Monday (November 22nd).

As was to be expected, the boy's family is far from happy with what the school is doing.

In the end, the conflict could even land in court. 

Basically, dealing with students who are absent without excuse - and test refusers are considered as such - is subject to the individual case principle.

"The schools have different enforcement measures," explains Martin Rohde, ministerial representative for high schools in Middle Franconia.

Instead of letting the police fetch the test refusers from home with the police, as the truants used to do, the schools tend to try to keep the students.

If the family does not change their mind, fines have been imposed by the district administrative authority since the beginning of November.

The district administration authority can call in the youth welfare office if it sees the child's well-being endangered by refusal to attend school.

So far, says the legal office of the city of Nuremberg *, no fine proceedings have been initiated against test refusers.

The Adam-Kraft-Gymnasium pupil complained that he was not being informed about upcoming performance surveys by the school. She doesn't even have to do that. The Ministry writes, with a view to the unexcused lack of students: “This announcement is usually made in face-to-face class with the class. Pupils who were absent on the day of the announcement inform themselves from their classmates or the teacher about the subjects covered on the day of their absence and accordingly also about any performance records that may have been announced during this time. There is no explicit obligation on the part of the school to inform absent students about upcoming performance records. " 

Since the compulsory attendance was reinstated, it is also at the discretion of the school whether or not to send study materials to those who refuse to take tests.
