If the Miesbach District Office does not - as instructed - issue a corresponding ordinance for the Mangfall Valley water protection area by December 1, the government of Upper Bavaria could do this itself.

The order from the district caused astonishment and horror in the district.

With a petition, the affected municipalities - the city of Miesbach, the municipalities of Warngau and Valley, the association Unser Wasser, organic farmer Alois Fuchs, Marion and Kartz von Kameke (Bio-Gut Wallenburg) and Martina Eck - hope that their areas will actually be closed avert.

The petition was now handed over to the President of the State Parliament, Ilse Aigner.

"Nobody questions Munich's water supply and nobody questions the need for water protection areas," emphasized attorney Benno Ziegler, who represents the petitioners.

He presented the request in the morning before the petition was handed over as part of a press conference in Miesbach.

"It's a fight for the rule of law," he said.

The re-designation of the Reisach-Thalham-Gotzing water protection area must be carried out in accordance with the law.

The petitioners expect nothing less than due process.

“What we cannot accept,” explained Ziegler, “are threats and the breach of agreements”.

This meant the possible so-called self-entry of the district government, if the district office does not issue a grazing and fertilization ban, as well as a current report that should clarify the need for a grazing ban and is now ignored.

Professor Uwe Tröger from the TU Berlin has worked out that the bacterial load in the water cannot be attributed to cows in the pasture.

Only three days on which contamination was found were in February, i.e. at a time when there are no cattle outside.

Instead, Tröger attributes the germ load to the sewage treatment plants in the region, which sometimes have to divert water into Mangfall and Schlierach during heavy rain.

In this context, Ziegler also criticizes the fact that the Munich municipal utilities do not disclose any data on the contamination.

"I would have liked transparency," said the lawyer and thinks: "The new findings must be properly processed." The problems, he explained, "do not lie in the fact that two cows per hectare are on the pasture".

Stadtwerke München has been promoting the quality of the water it produces in the Mangfall Valley for decades.

It is therefore clear to the petitioners: The current regulations are sufficient.

"If there are to be changes, then in a constitutional process and not in a rush-hour action," Ziegler made clear.

The petition to the state parliament is supposed to guarantee that.

The municipalities, our water and the organic farms expect the state politicians to instruct the government of Upper Bavaria to withdraw the ultimatum given to the district administrator on December 1st and to refrain from taking action.

The district office should lead the procedure - as a new start, transparently and with all current knowledge.
