The operator of the horse farm had already submitted three building applications in August: for a riding hall (20 by 30 meters) instead of the existing sand area, a second open stable (12 by 28 meters) in the rear area of ​​the property and the extension of the existing manure area.

The applications were postponed because the municipal councils did not find the placement of the hall and stable optimally.

The client was advised to seek advice from the District Office, which, according to Mayor Leonhard Wöhr (CSU), she is likely to take advantage of.

In principle, the municipality has no right of decision in this case anyway.

The approval authority is the District Office, and the assessment of the Food, Agriculture and Forestry Office (AELF) in Holzkirchen is also essential here, because it has to determine the privilege.

Fertl alluded to precisely this privilege. The only thing on the agenda of the meeting was the motion to extend the manure place. The local council of the Independent Voting Association Goldenes Tal (UWG), however, wanted to "send a signal in the direction of the AELF" and initiate a discourse on whether the privilege of horse stables was appropriate.

Franz Demmelmeier (SPD), whose family runs a horse farm themselves, explained why this privilege exists.

Many agricultural farms that have been abandoned in recent years have continued to be cultivated, including their land, or the farmers have created an additional pillar by keeping horses, he said.

“That is perhaps less the case here with us, but it is definitely the case in other parts of the country.” Pension farms are also an economic factor, but of course they can only be operated outdoors.

Competition for arable land

Anian Rutz (UWG) nevertheless viewed the privilege critically and brought the lack of agricultural land into play. If a farmer creates a second mainstay for himself by keeping horses, that is something else, he thought. Because it then competes with itself in terms of area. Rutz also alluded to the dimensions of the new buildings planned in the Golden Valley. “We're talking about 1560 square meters of roof space,” he said, “that's the size of a supermarket.” He sees absolute competition in such a company with food production. A rethink needs to be made so that communities are allowed to have a say, he demanded.

Food is not produced in the fields where green waste is grown for biogas plants, said Johannes Wieser (WiGW).

Of course, one could argue that they are used for energy production.

Nevertheless: "A horse farm is a trade and the landscape is well cared for," he said.

In view of the fact that the municipality had no decision-making authority, Mayor Leonhard Wöhr (CSU) ended the debate with a proposal.

In the resolution on the application for an extension of the manure site, the comment was added that the approval for this does not result in approval of the other, still to be expected building applications.

The committee supported this decision - because nobody has anything against a longer dung place.
