It is not uncommon to see illegal structures in urban areas. There are reports that the Buildings Department has recently "approached" three old buildings over 50 years old.

One of the buildings involved is the Wah Fung Building in Jordan. It is 57 years old. It is understood that there are a number of unauthorized structures on the roof of the building, including corridors and fences.

However, some small owners were dissatisfied. The Buildings Department alleged that the unauthorized building had existed decades ago and was suspected to be built by the developer.

The OC of the building, however, revealed another version to the reporter of "Hong Kong 01", stating that the unauthorized rooftop structure had fallen on Nathan Road during the typhoon. Therefore, the Buildings Department had issued a letter to the rooftop owner for clearance in 2019, and the OC I also issued a lawyer's letter this year.

In response to enquiries, the Buildings Department stated that the removal orders for unauthorized structures in the three buildings were issued in accordance with the illegal structure enforcement policy between 2017 and 2020.

The condition of some units on the top three floors of the May City Building is inconsistent with the plans approved in accordance with the Buildings Ordinance. After reviewing the relevant cases, there is a chance that the owners of the early years may be involved. In addition, if individual units take independent restoration measures The project may be difficult, so enforcement actions by relevant units will be suspended; if other cases have similar circumstances, the Department will also consider the same criteria.

The illegal structure of Wah Fung Building in Jordan has existed 4 years after the completion of the building

"Sing Tao Daily" reported that Jordan Wah Fung Building, Sham Shui Po Long Wah Building and Western District May City Building were all over half a century old. No project has been done.

Take Huafeng Building as an example. According to the aerial map of the Survey and Mapping Office of the Lands Department, the corridors and fences alleged to have been illegally built existed as early as 4 years after the building was completed.

A reporter from "Hong Kong 01" visited the Huafeng Building today and found that the rooftop unit is located outdoors, and there is a corridor covering about half a meter above the unit's entrance, which extends from the indoor stairs and is supported by iron branches on the ground.

Whether it is the iron fence covered or supported on the corridor, it is very dilapidated, and the ceiling has even seen concrete.

However, the Incorporated Owners of Huafeng Building stated that the roof has always been equipped with different unauthorized structures, not only the roof and the fence. The Buildings Department has issued a letter to the roof owner requesting removal in 2019, but believes that the owner knows it.

The corporation also plans to apply to the court for a forced demolition order to remove all illegal structures.

The unauthorised construction of May City Building is large or involves early big owners

In response to enquiries in the evening, the Buildings Department stated that the removal orders for illegal structures in Wah Fung Building, Long Wah Building and May City Building were issued from 2017 to 2020. Among them are the conditions and plans of some units on the top three floors of May City Building. Inconsistent, the relevant unit has carried out illegal construction works, so the department issued a removal order.

However, the department stated that after reviewing the May City Building case, considering that the illegal construction of the units concerned seems to be old and large in scale, it may involve the large owners in the early years. In addition, if individual units take independent restoration works, there may be problems. Because of the difficulty, the Buildings Department will suspend enforcement actions by relevant units.

The department also pointed out that it has contacted owners who meet the above-mentioned circumstances to establish some background facts and explore whether they can be dealt with in a pragmatic manner according to the current mechanism; if other cases have similar circumstances, they will also be considered under the same criteria.

However, the Buildings Department emphasized that if unauthorized structures involve independent structures and are not difficult to remove, such as unauthorized structures built on rooftops, the Department will continue to follow up on the mechanism.

Consumer Council | Misleading illegal payment of 20,000 solar panels for installation of solar panels has caused troubles, and the Ombudsman takes the initiative to investigate the three departments to review the enforcement actions of illegal construction of village houses and the driver’s licensing requirements. 4 times in the past three years, 444 small house unauthorized construction cases were prosecuted for the illegal construction of brick walls at No. 27 Lugard Road, a first-class historic building Fined about 180,000 yuan
