Tel Aviv Magistrate's Court Judge Shamai Becker sentenced today (Wednesday) to five and a half years in prison against Omar Harari, who was convicted of 25 violent offenses, threats and having sex with two women while carrying AIDS. In addition, he will pay compensation in the amount of 25,000 Shekels per complainant.

Harari was convicted based on his confession to the facts of the indictment, for committing 16 offenses of assaulting a spouse, five threatening offenses and two offenses of assault causing actual bodily harm and committing an act that could spread a malicious disease.

According to the indictment, the defendant and one of the complainants had a marital relationship last year between the months of June-September, however they lived separately.

The second complainant in the case, had a marital relationship with the defendant from December 2019 to April 2020 and she also lived separately from the defendant, together with her 13-year-old daughter.

According to the indictment, during the marital relationship between the defendant and the two complainants, Harari told them that he was the son of a "known offender" and thus instilled in them fear.

It is further described that he was diagnosed as a carrier of HIV disease and on excellent charges that throughout the relationship he beat the two quite a few times.

On one occasion an argument broke out between one of them and Harari, and she told him that he was violent towards her and that he was cheating on her.

In response, he slammed her head against the wall, twice, "until the complainant felt she was losing consciousness";

Next, he punched her in the lower abdomen on the right side, asking if he wanted to kill her.

Harari then hit her with a punch in the chest, and as a result of these acts she fell to the floor and was unable to get up.

"Harari continued to shout and curse the complainant, picked up her phone, broke it with his hands, and threw it away; later, she ran to her daughter's room, the defendant chased after her, and she lay down, crying, on the daughter's bed."

E., one of the complainants, told about the damage caused to her daughter as a result of the past events.

"I am here because the court will not forget the suffering she went through and to this day she suffers from severe anxiety and is being treated with psychological treatment. Since the events her condition has worsened in her studies and personality."

Later, A. shared the feelings when she found out that Harari had AIDS: "It is a suffering that cannot be described in words. I was sure I was sick and as I explained it happened on a holiday that could not be tested. We were in a state of uncertainty for four days and I think it was death in itself "Not to mention the suffering of my little daughter who is sure her mother is going to die."

Judge Becker noted that Harari had harmed the complainants' personal security, trampling on the value of maintaining their integrity of body, mind and dignity.

"Beyond the violation of the 'normal' protected values ​​in the context of domestic violence offenses, Harari violated, in a special and extreme way, the peace of mind of the complainants, and posed a risk to their physical integrity, given the fact that they had unprotected sex while carrying the AIDS virus.

"While the complainants did not contract the disease, not due to a special effort by Harari, but only thanks to their good fortune, relatively of course, this does not detract from the moral slump involved in this type of behavior," Judge Becker wrote.

He also wrote: "Even when a loving hand was placed on Harari, the reaction was sometimes painful. In other words, the complainants could not know where and why the next attack would come. Did you talk to someone? A slap. Did you receive a message on your cell phone? A slap. "And more and more, constantly."

Judge Becker summed up the sentence by saying that Harari's indifference is outrageous and shocking.

"The fact that he behaved in this way towards two women doubles these feelings. Yes, you will get sick, you will not get sick, what do you care? What do you mean by mountains and worry about it at all? Also provides him with free housing - what does it matter at all, whether you get the disease or not? Harari treated these two women, whose every sin amounted to seeking love, as objects to fulfill their needs. And objects are objects. If so, who cares if an object "breaks down" and catches AIDS? "Harari said," the judge wrote in the sentence.
