At the height of disciplinary proceedings against Rabbi Shmuel Eliyahu, rabbi of Safed, for speaking out against Arabs and the proud community, the government will on Sunday approve a proposal aimed at transferring the disciplinary authority of city rabbis to Minister of Religious Affairs Matan Kahana, similar to 2003. This authority is handed over to the Minister of Justice, and from the moment the government approves it, the decision will take effect within a month, and it is not clear how it will affect the proceedings against Rabbi Eliyahu.



Since the dissolution of the Ministry of Religions 18 years ago, the authority to disciplinary prosecute the city rabbis has come out of the hands of the Minister of Religions, passed to the Prime Minister and later to the Minister of Justice.

Over the years there have been attempts to amend the law with the aim of making the disciplinary procedure against city rabbis present and effective but these have not succeeded.

The explanatory memorandum to the proposal that will be made by the government states that "the current legal situation creates an anomaly, according to which the authority to file a complaint is in the hands of the Minister of Justice, unlike the other powers under the law in the hands of the Minister of Religious Affairs."

Minister Kahana's entourage stressed that this is a "procedural procedure only" but stressed that the minister will examine any disciplinary incident he may have "in the belief that city rabbis deserve upgraded freedom of expression, stemming from the freedom of halakhic jurisprudence."



In addition, we noted that the Minister intends to embark on a broader move that will protect the freedom of expression of rabbis, but at this stage it is not yet clear whether in legislation, regulations or other tools.

According to Minister Kahana, "It is my duty as Minister of Religions to ensure that the voices of the rabbis are heard in a dignified and fearless manner. That they have the right to have their voices heard by an audience."
