Erdweg - Relief in the Erdweg town hall: As has now become known, the Kleinberghofen ex-couple, who sued the Erdweg community because of the local model, withdrew the appeal, according to the press release by the Higher Regional Court on Friday.
The decision of the regional court is now final.
The background is the lawsuit of the family, which wanted to sell the house and property in Kleinberghofen for a transfer fee at the current market value - before the end of the actual commitment period. The community, represented by Mayor Christian Blatt, argued that if the right to redemption were required, the entire local model would come to nothing. The district court gave the municipality the right in the first instance. The contracts for the local model are clearly formulated, it said.
So now the final decision, which Mayor Blatt not only hoped for, but expected.
"We are glad that our model has held up in court," emphasized the community chief.
Everything is precisely formulated in the contract.
Otherwise, according to Christian Blatt, one should have been concerned about what would happen to the other contracts that are still in the self-use phase.
Or what applies to future contracts in the local model.
