It meets when a disaster or health emergency has been declared or government measures, such as exit restrictions, have been ordered.

In the case of corona, the seven-day incidence must be over 150.

The precondition for the establishment of the crisis committee is always a resolution by the municipal council.

The committee consists of eight members plus the mayor.

The entire municipal council reserves the right to discuss and pass resolutions on the 2022 budget.

Special regulations in Kochel

Crisis committees are controversial and had caused discussions across Bavaria in the recent Corona period. In June, the party “Die Linke” won a lawsuit before the Bavarian Constitutional Court against communal corona committees (Article 120b (3) of the municipal code). The judges declared this paragraph unconstitutional because it was inconsistent with the principle of equal voting rights.

This judgment does not affect Kochel, said Mayor and lawyer Thomas Holz at the meeting.

In the community, the crisis committee was regulated in a special way: every parliamentary group, committee community and voter group was represented in the crisis committee.

In addition, the duration of the appointment is limited in time.

The time has now come for the mayor to set up the committee: “As a local council, we have a role model function.

We cannot ask the citizens to reduce their contacts and we will continue as before, ”said Holz.

Dollrieß referred to the judgment on Article 120b, but was advised by Mayor Holz that it was not applicable to Kochel.

Wood also corrected Dollrieß's objection that the Free Voters were not represented in the crisis committee: "They form a committee with the SPD and have decided to send Mr. Barthel to the committee."

Jens Müller (UWK): "Compromise is well thought out"

Like Dollrieß, Klaus Barthel argued with distance and hygiene measures. "The trend in incidence has nothing to do with the size of the session," said Barthel. In addition, the crisis committee meets in camera. At this sentence, Mayor Holz countered sharply: “That's not true.” Both the press and a certain number of listeners could take part in the meetings. “Don't keep putting something wrong in the room,” he admonished Barthel.

Jens Müller (UWK), once a critic of the crisis committee, said: “I stand by the compromise made at the time.

It is well thought out and I now see my duty, ”said the lawyer.

Nevertheless, he understood the arguments of his fellow councilors.

The only thing he does not think is good is that a decision on the further establishment of the crisis committee in January is made in a written circulation procedure.

Sonja Mayer: "The prerequisites were different back then"

Sonja Mayer (Die Mitte) advocated “suspending and not implementing” the 2020 resolution: “The requirements were different back then.” She also referred to the distance and hygiene rules in the conference room. "The risk of infection here is low." Bettina Sindlhauser (Freie Bürger Ried) commented in a similar way: "We should all test ourselves beforehand, as in schools." Holz countered that rapid tests did not provide absolute certainty about an infection. "You can still carry the virus and be contagious."

Frank Sommerschuh (FW) agreed with Mayer and Sindlhauser.

For him, the municipal council is "to be assessed like a workplace".

He wanted to know from Holz whether Kochel was the first municipality in the district.

"I do not know that.

And what would that change, ”replied the mayor.

Sommerschuh said: "Why should we be the first?" Max Leutenbauer from the CSU, on the other hand, thinks it makes sense to set up the committee: "We all don't know how the Corona situation will be in three weeks."

In the following vote, seven councilors were against a crisis committee: Mathias Graf (CSU) and Rosemarie Marksteiner (Die Mitte) as well as Barthel, Sommerschuh, Dollrieß, Mayer and Sindlhauser.

Ten councils, however, voted in favor.
