The Supreme Court has finally ruled: the boy Eitan Biran will return to Italy in two weeks
The court rejected the appeal of his grandfather, Shmuel Peleg, and ordered the return to Italy of the boy who survived the cable car disaster in which his parents and brother were killed.
According to the decision, he must return to his usual place of residence within 15 days.

The Supreme Court today (Monday) rejected the appeal of the Peleg family and ruled that the child Eitan Biran will be returned to Italy within two weeks.
Biran, who lost his parents and brother in the cable car accident in Italy in May, was abducted to Israel by his grandfather, Shmuel Peleg.

In doing so, he upheld the ruling of the Family Court, according to which Eitan was abducted from Italy to Israel, and that he must return to his usual place of residence in Italy.
On October 25, the Tel Aviv Family Court ruled that Biran, who survived the cable car disaster in Italy, would return to live with his family in Italy.

The court did not accept the grandfather's claim that Israel was Eitan's usual place of residence, nor the claim that Israel and Italy both served as his place of residence. Because Ethan moved with his entire family to Italy when he was only about a month old, "his life, his experiences, and the facts of life and his own life story must be taken into account." It was therefore determined that Eitan's 'normal' place of residence was in Fabia, Italy, together with his aunt, and that the fulfillment of the principle of continuity in his life "tipped the scales for adoption."
The Peleg family said after the decision that "the State of Israel today gave up a Jewish child and a helpless Israeli citizen without his voice being heard, in favor of living in a foreign land, far from his beloved family and the place where his parents and younger brother are buried. We will continue to fight legally to return "The disconnection that was forced on him by his aunt from his mother Tal's family. We call on the Italian authorities to re-examine the poor decision-making process, which is why Eitan had to be torn from his family again."
